Section 7

Section 8

Spare Parts Availability & Lead Times

US Inventory Commitment

Elika maintains a strategic inventory of essential spare parts at our US Warehouse to ensure the fastest possible response times. We strive to fulfill warranty requests immediately from local stock.

Lead Time Disclaimer

Availability is subject to inventory dynamics. If a part is out of stock locally and requires shipping, standard manufacturing and shipping lead times will apply. Elika makes no guarantee regarding specific delivery dates for warranty parts.

Freight & Shipping

The replacement part is provided free of charge under warranty. However, the customer is responsible for all shipping and freight charges to transport the part from Elika's warehouse to the customer's location.

Product Evolution & Substitution

Elika reserves the right to substitute a part of equal quality and function if the original is discontinued. Substitute parts may differ in aesthetic design or color from the original.

Sections 9–10

Shipping, Delivery & Lead Time Policy

Estimated Lead Times

All lead times provided by Elika are estimates only. Standard timeline for custom projects is 12–14 weeks, subject to global supply chain dynamics and seasonal volume.

Production Start ("Lead Time Clock")

The production timeline starts only when both conditions are met: (1) receipt of a non-refundable 50% deposit, and (2) the Buyer's signed approval of final Shop Drawings. Any delay by the Buyer in payment or drawings extends the delivery date day-for-day.

Delivery — Curbside Only

Unless explicitly contracted in writing, all deliveries are curbside only. The shipping carrier's responsibility ends at the curb. The Buyer must provide sufficient labor or equipment to unload immediately. Drivers are not permitted to enter the home or transport goods upstairs.

Site Accessibility

The Buyer warrants that the delivery address is accessible by standard commercial freight trucks (up to 53-foot trailers). Any costs for last-mile transfer due to access issues are the Buyer's responsibility.

Important — Do Not Schedule Labor Prematurely: The Buyer is strongly advised NOT to schedule installation labor, remove existing windows, or commence demolition until the product has been delivered, inspected, and confirmed to be correct. Elika is not liable for contractor waiting time, cancellation fees, or temporary housing costs resulting from delivery delays.

Receipt & Bill of Lading

The Buyer must inspect crates before the driver leaves. If there is visible damage, clearly note "DAMAGED" on the driver's paperwork. Signing a clean receipt may limit your ability to claim shipping damages. Hidden damages must still be reported within the 48-hour window.

Storage & Unclaimed Goods

If the Buyer cannot accept delivery within 14 calendar days of notification, Elika may charge a daily storage fee. Goods stored beyond this period are held at the Buyer's sole risk.

Section 11

Cancellation & Return Policy

Custom-Made Orders

All custom windows and doors are final sale — they cannot be resold once production begins.

  • 48-hour grace period: Cancel for a full refund within 48 hours of order placement.
  • After 48 hours: order is "Locked" — no cancellations or refunds (except valid warranty claims).

Stock / Online Orders

Standard stock items may be cancelled for a full refund at any time before shipping.

  • Returns after delivery: submit request via website within 48 hours of receipt.
  • Product must be brand new, uninstalled, unused, and in original packaging.
  • 20% restocking fee applies for returns due to buyer's remorse.
  • Buyer is responsible for all return shipping costs (if no defect).
Section 12

Product Specifications & Standards

Inert Gas (Argon) DisclaimerArgon gas naturally dissipates over time. Loss of thermal efficiency due to gas migration is not considered a defect and is not warranted.
Glass Visual StandardsMinor imperfections, wavy distortions from tempering, or variations in glass color/texture are inherent to the material and are not considered defects.
Door Slab Alignment (Deferral)Elika may defer action on door warpage/alignment claims for up to 12 months to allow the slab to acclimate to local humidity and temperature.
Screen MeshWarranty for screens covers frame and mounting components only. Screen mesh tears or punctures are not covered unless reported within 48 hours of delivery.
Section 13

Additional Terms

  • Acceptance: Completing the purchase process and receiving the product constitutes binding acceptance of all policy terms.
  • Transferability: This warranty is valid only for the original purchaser and is non-transferable to any subsequent owner or third party.
  • Original Installation: Coverage applies only to products installed in their original location. Relocation or reinstallation voids this warranty.
  • Color Retention & Fading: Only abnormal color changes exceeding industry-standard Delta E specifications are covered. Minor fading from natural weathering or unequal sun exposure is considered normal wear and tear.
  • Severability: If any provision of this warranty is found invalid or unenforceable, the remaining provisions remain in full force and effect.
Section 14

Limitation of Liability

Exclusion of Damages

In no event shall Elika be liable for any incidental, consequential, indirect, or special damages, including but not limited to: damage to flooring or furniture, loss of time, security costs, or labor costs resulting from the sale, installation, or use of any Elika product.

Maximum Liability Cap

The maximum liability of Elika under any circumstance is strictly limited to the original purchase price paid for the specific defective product.

Section 15

Dispute Resolution: Mandatory Arbitration & Class Action Waiver

Agreement to Arbitrate

You and Elika agree to resolve any dispute arising out of Elika products through binding arbitration, rather than in a court of law. You and Elika waive the right to have a judge or jury decide disputes.

Class Action Waiver

You waive all rights to proceed as a member or representative of a class action lawsuit or class arbitration. All disputes must be resolved on an individual basis.

Opt-Out Rights

You may opt out within 90 days of purchase by emailing info@elika.world with the subject line "Arbitration Opt Out." Opting out does not affect warranty coverage.

Applicable Law: This agreement shall be governed by and interpreted in accordance with the Federal Arbitration Act (FAA) and applicable state laws.
